change of status
I applied H1 in Apr-2008. I got H4 Visa on june 21 and entered US with H4.
H1 petition is approved and is valid from Oct-1-2008. I have the current I-94 is for H4.
1) can i apply for Change of Status from H4 to H1 without going out of US and rentering while my H1 was filed when i was in india ?
2) What is the procedure to apply Change of Status from H4 to H1? 3) How long will it take?
4) how much will it cost ?

Yes, you can apply to change status, but it might not be worth it because you have to file a whole H-1 petition, not just a change of status application. Without counsel, that's not so easy to do. It might be easier to travel, though not as secure as an attorney preparing a change of status. But you might prefer to have an attorney prepare a visa application and travel because you are ineligible to work until the H-1 change of status is approved, which takes about three months in California and other western states, with time frames similar in other parts of the U.S., that is unless you premium process for an extra $1,000 paid to the government. In that case, the petition and application to change status takes 15 days, not including regular filing fee or attorney fee.

Yes...you can apply for change of status here. Eventually you have to go to india to get H1 stamped on your passport. Please contact me directly.
