change of status from L1/L2 to B2 tourist visa

Hi,

My company is closing on june 30th so my L1 & L2 for wife will get invalid. My wife is pregnant with 32 weeks of delivery. Now can I change status to tourist visa from L1/L2. If yes, then how about the insurance for pregnancy for my wife ?

Dear Inquirer:

You may file for a change of status to B-2 on June 30, 2009, but the USCIS will not adjudicate the application before July 30, 2009, as it usually takes at least 90 days. If you do not stay in the US past the date on your I-94, you will not be accruing any unlawful presence in the US, so there would be no penalty incurred.

You could request a change to visitor status, however it might not be granted unless you could show that she cannot travel for medical reasons. If she could go home and have the baby there, CIS is unlikely to approve visitor status. I can't tell from your question whether your wife has 32 weeks left in the pregnancy, or if she is 32 weeks into the pregnancy and therefore has only a few weeks left.

The question of insurance is not an immigration issue. You would be responsible for arranging medical insurance if your company could not continue to cover you.
