change of status from L1/L2 to B2 tourist visa as wife's pregnancy is near
Hi,
My company is closing on june 30th so my L1 & L2 for wife will get invalid. My wife is pregnant with 32 weeks and the due date is 30th July. Now can I change status to tourist visa from L1/L2. Can we stay legally after filing change of status to B2? If yes, then how about the insurance for pregnancy for my wife ?

Dear Inquirer:
You may file for a change of status to B-2 on June 30, 2009, but the USCIS will not adjudicate the application before July 30, 2009, as it usually takes at least 90 days. If you do not stay in the US past the date on your I-94, you will not be accruing any unlawful presence in the US, so there would be no penalty incurred.

Changes of status to visitor status, particularly after the end of a working status, depend on a detailed set of plans supported by evidence of your temporary intentions to be in the U.S.
