Legal Question in Immigration Law in California

Child Born outside the US

I am an american citizen (naturalized in 1995). My wife is not an american citizen, but a Pakistani national. I moved to Qatar in 1997. Since then, we have been living in Qatar and have two kids aged 10 and 5. Are my kids US citizens? How do I get a US passport for them?

Re: Child Born outside the US

Since your wife is not a USC, your children are not US citizens. You will need to file Form N-600 K and apply for their citisenship status.

Generally, a U.S. citizen may register the birth of his or her child with the U.S. consular post abroad before the child turns 18. You may wish to contact the nearest consular post to find out how you may do this.

Re: Child Born outside the US

Yes, they should be, barring unforeseen issues, but there are some further details you will want to know. The Embassy can issue passports and confirmations of US citizenship, but please don't just go there. If there are certain issues, presenting yourselves incorrectly could produce greater problems than had you not gone.

I'm happy to further consult regarding this. I am out of town to an immigration lawyers conference, and won't have ready access to email. Email me at [email protected] directly for further information. I will personally respond upon my return.

Best regards,
