Legal Question in Immigration Law in California

my child cannot come to Peru due to his future medical therapies, he had two surgeries in the last 12 months, he is one year old. his recent surgery will finally allow him to eat, he used to have a little hole inside his mouth. I got a copy of a marriage with my wife but she recently due to our distance have filled for an anullment without telling me, we got married in Peru but she filled in her county.
I was give it a voluntary departure and my ban is the 10 years. I wonder if I can continue the waiver processs showing some tipe of profe that she did not want to help because she went back to alcohol and her meetings and emotional issues have affect our relation. I am in Peru now.

You can do a Deferred Enforced Departure Petition which would have a reasonable chance if done properly.
