citinzenship

Hello i been a permanent resident of

the united states for 4 years and 10

months but i recently got a

misdemeanor dui can i still apply for

the us citizenship? or do i have to

wait another 5 years? please help

Dear Inquirer:

USCIS cannot approve your naturalization application while you are on probabation. Since a simple DUI is not considered "crime involving moral turpitude," you should not have to wait 5 more years to file, as long as your probation will be complete before your interview for naturalization.

Unfortunately no; having a good moral character is a prerequisite for naturalization. Since you must be in probation you will not be qualified.
