Legal Question in Immigration Law in California

Hi, I am a US citizen. My Aunt is also a U.S citizen, and has applied for her sister (my mom). I have an underage sibling. Can I only apply for my dad while my mom stays under the aunt's petition? The primary reason is that I want my sibling to come along with mom, as my sibling will not be able to come if I apply for both parents.

Hello:

It will take many more years if you do not apply for your mother. Please contact me for more information.

Yes, you can apply for your father only. Once your father becomes a permanent resident there will be two options: 1. your father can petition for your mother and your sibling or 2. your mother can wait and apply with your sibling when the priority date on your aunts petition becomes current, depending on whichever of those options is faster at that time.
