Legal Question in Immigration Law in California

I am a U.S. Citizen and I'm wondering if it is possible to bring my dad and step-mother along with my younger sibling to come live in the U.S? They are currently living in Mexico

This is a common question and one that has an unfortunate answer. Yes you can file for all three. However there is no fast way to bring your younger sibling here. The reason is that even if you file for your father as an "immediate relative" there is no derivative beneficiaries of that petition permitted. Essentially your younger sibling can't hop on that train and come along. You can file a petition for your sibling but that will fall into a preference category (Family 4 - See visa bulletin) and there is a substantial backlog for those cases and it could take years before your sibling could use that petition to immigrate. With all that said, we always push our clients to file the case as soon as possible because you can't get to the front of the line until you get in line! Feel free to reach out to us for assistance.
