Legal Question in Immigration Law in California
Citizenship waitting time
Me and my wife applied for citizenship on mid January 2007. My wife got her citizenship five months later. For some reason I was not called for an interview.
I found out that most of the applicants get their citizenship in 3-4 months.
I wrote to the USCIS and the only answer I can get is that my background check is still open.
I have no criminal record, neither here nor my home country.
I met a woman that already waits 2 years and a guy who told me that he is waiting already 12 years.
Since I do not want to wait 12 years not either 5 years my question are:
Is there any legal action I can take against the USCIS?
If yes, how long should I wait before doing it?
Can you please give me more details about what are my options?

You can file a lawsuit against the government for undue delay. Please contact us for more information.

I have successfully resolved long-standing naturalization cases by working together with the state senator's office to lobby for adjudication as well.
