Legal Question in Immigration Law in California

Clearing up Immigration Status

My husband immigrated to the US fifteen years ago. He applied for a social security number and a green card. He never received his green card but continued to work. The social security administration states that his status is ''immigrant''. We have been married now for over five years. I would like my husband to clear up his status and naturalize but his is afraid to stir the pot and end up deported. I can not imagine raising our children alone is this happened but I also do not like the uncertainity of our future (no social security benefits, etc). Is there anything we can do at this point to assure that he is not deported if he attempts to naturalize?

We need to do a FOIA on him to get his file. Then we can clear up any glitch he has. How did he immigrate though?

Yes. You can ask the DHS to provide you with you with all of the information it has on or about your husband. This is called a FOIA request. FOIA stands for Freedom Of Information Act. You can find more information on this at Citizenship and Immigration Services (USCIS)'s website www.uscis.gov
