Legal Question in Immigration Law in California

Conviction options and Green Card...

I have H1B visa and I'm in process of Adjustment of Status through my company, not filed form 485 yet. But just recently I was involved in a very bad situation and was arrested and charged with misdemeanor. I'm waiting for the court now. That's the first arrest in my life, never even had a parking ticket before. My attorney told me that there are very good chances to get one of the two options: 1. The charge can be changed to ''infraction''. 2. ''Deferred prosecution'' (or adjudication, not sure what's the right term for that). So, the question is: with which one I have better chances for Green Card? First one still keeps conviction, although not serious, the second one doesn't, but there is some period of time when the conviction is pending. Thanks in advance.

Re: Conviction options and Green Card...

If it can be dropped to an infraction, then there would be no adverse immigration consequences. Good luck.
