Legal Question in Immigration Law in California
Criminal record and marriage fraud penalties
I have a couple of questions. My friend is thinking about marrying someone she has been dating because he could get deported shortly. The thing about it is that he has a criminal record, including at least 11 different convictions and at least 1 felony. He is actually in prison right now. I don't what his immgration status is but she said he and his immediate family are all facing deportion after being here about 10 years. The other part to that is that I don't want her to get into any trouble for a fraudulent marriage. I think there are pretty serious consequences for that. The facts are that she had only been dating him about two months before he went to jail again. They never lived together, he is not supporting her or will not be if they get married. They will never have a chance to have evidence of any legitimate marriage as I think he has immigration court while he will still be in prison. Someone please advise.

Re: Criminal record and marriage fraud penalties
If you're a good friend, why the heck would you allow your friend to be dating a loser like this? This is a complete total loser!! He should get deported from this country.
I don't mean to be harsh here (well, maybe I should) but with that kind of massive rap sheet (11 convictions!!!), he has no chance in removal (deportation) proceedings in front of an immigration jdge. Your friend should be aware this is no wimpy proceedings in front of clueless imimigration officers but with a black-robed, very serious, and very smart judge, plus government attorneys representing the Dept. of Homeland Security. And yes, your friend may get in trouble in federal prison + $250,000 fine for marriage fraud. Tell your friend to drop this loser like a ton of bricks.
