Legal Question in Immigration Law in California
I am a current holder of an H1-B Visa (of Indian origin), which expires the end of this month. (September 30th 2009). My employer and me are going to severe our relationships at the end of this tenure & I am not going to have my visa renewed via them. I would like to know how long I have available to leave the country, and if there is a stipulated grace period which I could use towards wrapping up outstanding issues, close accounts, ship my belongings and pack up.

Once you or your employer terminates your relationship, you would no longer be in H-1B status. If you are employed through 9-30-09, the date that you say is the expiration date of your approval notice/I-94, you would have a 10 day grace period after that to leave the U.S. Note, that assuming you still have remaining time of your total of 6 years in H-1B status, you could try to find another employer to sponsor you for an H-1B, and if they submit the petition to extend your stay based on this new employment prior to your I-94 expiration date, then you could port to that employer under AC-21, and begin working for them right away. I would be happy to assist you with this process. For further questions, you may call us at 415-387-1364 or email at [email protected].
