Legal Question in Immigration Law in California
divorce and citizenship
hello,
here is the situation:
1)my wife was recently approved for permanent resident.
2)we're in the process of filing for divorce due to irreconcilable differences
3)we are not living together, and have separate accounts, and everything
4)we agreed to have an uncontested divorce
questions
1)if i file for divorce right away, and later, when she applies for citizenship, do you think the INS(during the interview process) will suspect that i am marrying her in order for her to get a green card? our marriage is legit.
2)do you think the ins will look further into our files and ask her tough questions during the interview process that she can't answer?
3)do i still have to have joint accounts for everything until she became a US citizen?
we are basically having separate accounts for everything. because we want to make the divorce go smoothly. this is all being done while we were waiting for approval of her permanent resident status. thank you for all of your help.

Re: divorce and citizenship
I don't know whether CIS will suspect or check further. But in case that happends, joint account is only one kind of evidence to prove your good faith marriage. There are other kind of evidence, such as pictures with families and friends that can show your good faith marriage.
