Legal Question in Immigration Law in California

divorce-green card

I am supposed to get my conditional green card in one month. I had an interview last week but they needed taxes for 2003 which we didn't have with us because my husband gets extension and I am going to send it to them this week so everything should be ok. But the marriage I have been in is very abusive I have called cops on my husband few times, I have been to psychologist twice. I couldn't go more because I don't work and my husband found out about it , got mad and took all the money from the account and so on. what I am looking for is the attorney who has experiences with something like this and can tell me If there is a chance for me to stay in US and be resident If I file self petition and for divorce. I can't stay in this marriage anymore. I am locked here and it is killing me and I don't want to lose my status here either.

thank you .

Re: divorce-green card

As an abused/battered spouse of a US citizen you have the right to self petition as a special immigrant. I have handled several of these cases successfully. The important factor is documenting and proving the ongoing abuse.

You can get (1) a restraining order; (2) domestic violence-abuse vicitm counseling free of charge (there are free clinics just try to look them up; (3) keep a diary with details of abuse conduct; (4) take pictures of your body if there are bruises, etc.; (5) get names of willing witnesses who would support you.

The most important thing you should do is GET OUT OF THE ABUSIVE RELATIONSHIP NOW before it is too late...

Good luck.

Based on the information you have provided, you should be able to leave the marriage and self-petition. I frequently handle similar cases. Please contact me if you would like more information.

My best wishes to you.
