Legal Question in Immigration Law in California

domestic violence and green card

Hi,

I am married 9 yrs and have 8 yrs old son also. Few weeks back I got into argument with my wife and then she called police falsely alleging that I beat her and got me arrested. If I can't prove my innocense in court and got convicted does this have any effect on my GC? What are my options here?

Thanks & Best Rgds!

Re: domestic violence and green card

It may affect your permanent residence if you were convicted of a crime of violence. However, if you obtained your permanent residence more than five years ago, and you have been physically present in the U.S. for more than seven years in any legal status, then you will have the option to keep your permanent residence in case you have to go to see an immigration judge.
