Legal Question in Immigration Law in California

Due to Operation Predator my father was picked up.

My father, 69, was convicted of lewd and lascivious acts upon a minor under the age of 14 in 1984. He plead no contest to one count. He was sentenced to 8 years in state prison. He only spent 4 years and was released on good behavior. He has had a clean record ever since and has registered every year. He was detained by Homeland Security from his home on January 21st. He is now being held in San Pedro and we want him out. He has a lot of children and grandchildren in the area and he is married to my mom, a US Citizen (naturalized). He has a court date on March 9th and we want someone right away. Please help! Advice, or a lawyer referral is much appreciated. I am his daughter

Since your father had committed a crime involving moral turpitude...he is also an aggrivated felon by INS definition because he was setenced for more than a year....your father is not eligible for cancellation of removal. You need a lawyer in LA, not some guy in San Jose! Every one who has a court date in Immigration Court in LA hires an LA immigration lawyer (there are hundreds of us), not some out of town guy. Do you want to pay for his plane tickets and hotel costs?

I can tell you that your father has an uphill battle to climb because his conviction is most likely an aggravated felony which deprives him of many kinds of relief in court.
