Legal Question in Immigration Law in California

enspongement

I have a misdemeanor DUI in the US. It is considered a felony in Canada. If I can get an enspongment, can I go into Canada. My domestic partner wants to move back. He is a citizen there.

Re: enspongement

This matter is complex and you should not try to do it yourself so you should get an attorney to discuss your options. If you are located in Southern California, you can email me your contact info, so we can discuss your particular situation. There is no charge for consultation.

If you have completed the terms of your sentencing on your DUI, you may have the misdemeanor conviction "expundged." However, that doesn't mean that no record exists of its prior occurrence and the limit of what I know in Canada is that it is an issue that must be revealed at inspecation.

Expunging the DUI I can do, for the rest, get a Canadian attorney. If you are going to Vancouver or Toronto I can provide referrals.
