Legal Question in Immigration Law in California
ETA 750 Part B - Permanent Residency
Hello.. I have about 2 and half yrs left on my H-1B and my green card process has just started. My company is sponsoring me. To start off, I was told by HR to fill out a preliminary ETA 750 part B for the company attorney to review before they call me. The attorney is Jenkens & Gilchrist. I understand that the ETA 750 part B is the most critical part of the process and I am afraid Jenkens & gilchrist is too big to give me individual attention to make sure it is filled out the best it can be and my problem is that I don't have too many skills that match the job that I got. I primarily got the job because the interview was excellent. I only have a bachelors degree in Industrial engineering and my job is in telecommunications (project management of telecom electronics deployment). I don't have any certifications or licences.
Although jenkens has my case, I need someone to sit down with me and go through my skills, resume, etc and match that with the job requirements to fill out the ETA 750 part B to the best it can be.
Thanks.

Sure, I would be happy to review this for you at a nominal fee.

you need competent immigration attorney to guide you through. Those two froms look simple but extremely inmoportant for Labor certification. Take a look at my site at www.lawyers.com/amyghosh

I perfectly understand your concern, which I believe is justified. I have been in this situation too many times not to know what you are going through. Here is what I can offer: we can teleconference on this and you get to work one on one w/ ME (not a paralegal or a secretary). Of course, I will not guarantee that you get your labor cert as that is up to DOL and if you do not have skills or educational attainement there is not much I can do. What I can promise is personal attention to this matter. You will get my direct phone number and I return most phone calls within 24 hours.

You probably have the right qualifications for the position in order to have had the H-1B approved in the first place. The company attorney should do a competent job of making sure your skills are properly reflected on the ETA 750 B. Nonetheless, a consultation with an independent attorney may be helpful in addressing your concerns granted any suggestions and modifications are implemented by the company's attorneys prior to filing the petition.
