Legal Question in Immigration Law in California

Expired Visitor Visa (of 7 yrs)

Short of marrying a US citizen or being sponsored by an employer, how can a person (over 18) with an expired visitor's visa obtain the right to work? Is the lottery his only option? His immediate family are all legal perm. residents and he has an expired foreign passport.

Re: Expired Visitor Visa (of 7 yrs)

Well, you've pretty much covered the options. The "right to work" is not so easily given to foreign visitors to the U.S., especially if the visitor was supposed to have left the U.S. 7 years ago after his visit here.

The immediate family can file a I-130 petition for him so that he can be put on the immigrant visa waiting list which, depends on the exact category, will not give him a visa until 5 to 8 years from now. In the meantime, he will have no right to work because of the filing of this petition.
