Legal Question in Immigration Law in California

Expiring H1B -- need 1-2 months to wrap things up and leave.

My H1B visa expires Aug 28 2009 at which time I intend to resign. My wife is in valid J1 status until 2011. We are planning to return to our home country in Oct-Nov 2009 timeframe. Should I apply for EOS to B2 in order to give me some time to wrap things up in the US after I have completed my employment? I definitely plan to leave by end-Nov 2009 if EOS granted.

No, you should apply for J-2, dependant of a J-1.
