Legal Question in Immigration Law in California

Fake marrage

I know someone who is planning on going to India to meet someone and then come back to the US and apply for a fiance visa so that person can come to the US. Then they plan to get a divorce and that person can stay here. Is that legal and if not what are the consequences?

This would be a fraudulent marriage with severe legal consequences, including but not limited to deportation if/when discovered.
