Legal Question in Immigration Law in California
My fiance entered the U.S. illegally with his mom when he was 7 yrs old, june 1995. They are from Armenia. His mom tried filing papers to obtain a green card for them but were denied. On feb 2010 they were also denied by the 9th circuit court. He is now 23 years old and we want to get married. What can be done for him?

If your fiance has 245 (i) and you are a U.S. citizen, he might apply for green card through your petition. We suggest you to consult with an immigration attorney.

It is perfectly legal for you to marry your fiance even if he is here illegally. However, you cannot petition for him to adjust his immigration status while he is still in the U.S because he came here without a visa. That said, you may still petition for him as a spouse if he qualifies for a 245(i). Contact an experienced immigration attorney to help your fiance. You may contact me for a free intial consultation.
