Legal Question in Immigration Law in California

fiance' visa

Hi. My fiance' and I have made it all the way to the interview process, but I am having a hard time finding a sponsor for him. I am a full-time student and unemployed, so I am unable to sponsor him myself. Are there any organizations that would be willing to sponsor him for me? Please help!

Re: fiance' visa

What kind of petition was filed for him?

If he already filed the I-485 (green card), the person or employer who sponsored him originally will have to show that they have the ability to support him financially. You may have already satisfied this requirement in the initial submission of the petition. However, with the limited information you provided, it is hard for me to tell.

To discuss your specific case further, kindly email me at [email protected], or refer to our contact information on our website at www.loretomedinalaw.com. We offer a FREE initial consultation and payment plans.

Re: fiance' visa

I have never heard of an organization being a financial sponsor in 30 years of practice for this type of case. If you're not yet married and are doing a fiancee visa from abroad (K-1 with I-129f petition), then anyone can be a sponsor on the I-134 Affidavit of Support. If you are filing the I-864, Affidavit of Support once married, then even though you don't meet the poverty guidelines, you must provide the paperwork for sponsorship and get another sponsor. It might be possible for your fiancee to be the sponsor - maybe, but I'd have to really check that - though even if permitted, it might raise issues about the how true your relationship is.

I would be happy to help you out if you contact me offline. Check me out at http://www.yardum-hunter.com, fill out a consultation request there at http://www.yardum-hunter.com/Main/Consultation.asp or email me at [email protected]. Until then, please don't rely on this as legal advice.

Re: fiance' visa

Dear Inquirer:

You must have a US Citizen or permanent resident provide an affidavit of support for your fiancee or husband, if your income is insufficient.

I recommend that you email [email protected] or visit www.hanlonlawgroup.com if you would like to schedule a confidential consultation to discuss this matter further.
