Legal Question in Immigration Law in California

I am about to file I-485 and I-130 for my spouse.

Should I file Form I-131 - Advanced Parole document even if my flight dates are not confirmed yet?

Thanks,

-Anil

The I-485 includes the I-765 and the I-131 so you file all concurrently and pay the one filing fee for all.

You cannot depart the U.S. unless you receive the approved I-131 or the I-485 will be deemed to be abandoned.

Please keep in mind that you should not file for an I-131 if your spouse has over 180 days of unlawful presence. If one leaves the country after accumulating 180 days or more of unlawful presence, there will be a 3/10 year bar to returning to the country even if an I-131 has been issued. Please feel free to contact me for a consultation.

Yes, you should include an Application for Advanced Parole document with approximate dates of your spouses upcoming travel.
