Legal Question in Immigration Law in California

Fingerprinting & Legal Residence

First of all, thank U for your assistance into these matters.

1) is there another place people could go to take their fingerprinting (eg. police dept, attorneys' offices) (to see if my boyfriend has any criminal history before applying for his residency, for expungement purposes) before going to the USCIS office to have their fingerprints done thru the FBI? We know that since he's here ilegally he'll have to leave the US to finish his residency process.

2) I'm a US citizen, if I petition my sister (older than 21 yrs old), she was previously married but never filed anything through her marriage. My mom petitioned my sister in 1994 but then my sister married, now she's divorced...if I petition for her, does she needs to leave the country or my mom's petition helps her w/ the 245I since it was back in 1994 even though later she married and divorce?

3) my brother will apply for his citizenship in three months, he lost his green card...does he needs to replace his green card first or can he apply for his citizenship without a greencard? He doesn't want to pay for a green card replacement fee and then for his citizenship process. Once again, thank you to all of you for making this website so helpful to us. Happy New Year!!

1/Yes there is, depending on the state where he lives plus FBI rap sheet.

2/It depends on if your mom is a US citizen or not.

3/According to the CIS Naturalization Guide: "Applicants who are lawful

permanent residents of the United

States must submit photocopies

(front and back) of Form I-551

(Permanent Resident Card)."
