Legal Question in Immigration Law in California

foreign workers

I am a recent US Citizen, living in CA. My father is a UK citizen and a highly skilled pipeline welder. He wants to work out here in the USA. Obviously he has no work permit, but can I, as a US citizen, get around that by forming my own US engineering company, bringing him out and sub-contracting him out?

As a USC you can file a petition for your Father as an immediate relative and bring him as a green card holder. If he is in the U.S. visiting then you would be able to petition for him and also file for his Adjustment of Status (green card) and apply at the same time for work authorization and a travel document. The easiest way is for you to petition your father as a US permanent resident. Once he is here, he is free to work.
