Legal Question in Immigration Law in California
a friend of mine was deported in 2008 and since then has entered again illegally and recently picked up by ice will he have to do jail time for the re entry

It depends. If the U.S. Attorney decides to indict him for Illegal Reentry and he's convicted of that charge, he can be sentenced to prison time. If the U.S. Attorney decides not to indict him, then ICE will reinstate his prior deportation order.
