Legal Question in Immigration Law in California

Hi, a friend of mine is trying to get his green card to be able to remain in the US. He has been here for about 10 years now. When he got here, he got married and put in an application which was later withdrawn due to complication. He was able to get his work to file for him using the I40 which has been in process for about 5 years now and that application was rejected because immigration was linking th emarriage incidence as fraud. He is currently going to appeal that. My question is, he is also looking to apply for asylum due to life threats on his life if he return back home.Does he put in th eapplication right away or wait for the appeal process? What other options are available to him.

Hello:

You state he is 'going to appeal'. The question is whether he actually ever had a ruling of marriage fraud. It is important to appeal correctly as a ruling of marriage fraud bars someone for immigration benefits for life.
