Legal Question in Immigration Law in California
I have a girl friend who is in the US on a green card. She is considering applying for US citizenship. She has been here for 10 yrs from Peru. She has 3 children and is divorced for about 8 yrs. She has a record for domestic violence. She found out her ex husband, when they were married had a girl friend and another child. In anger she pinched him enough to give him a sizable bruise. He filed a complaint and she spent the weekaend in jail. She was released on Monlday. Wound up with 200 hrs of community service. Has had no issues other than that. It happened in August 2004. She has been working all this time and still is. She has custody of her 3 kids. The youngest was born in the US. The other 2 were born is Peru. Will this issue stop her from getting US citizenship?
1 Answer from Attorneys
It is doubtful that the one offense, presumably a misdemeanor, would preclude her from naturalizing.
