Legal Question in Immigration Law in California

Green CArd and Citizenship

Hi,

It will be 5 years in March 2003 that i will have my green card. So when is the earliest that I can apply for my citizenship. I live in San Jose, CA. Also I am planning to apply for green cards for my parents who live in India. So when is the earliest that I can apply for them? And how long does it take for the green cards to come once i have applied for my parents?

Thank you for your reply.

Re: Green CArd and Citizenship

A permanent resident can begin applying for citizenship five years after receiving the green card (three years if the green card was obtained by marriage to a US citizen).

After taking the oath of citizenship, the new US citizen, if he or she is over 21, can apply for the parents. The INS approval can take about 6 to 8 months and then after that it will be up to the US consulate in the home country. The whole thing thus could take a year to finish but there isn't the long waiting list for visas that could take years as for immigrants in other categories.

Re: Green CArd and Citizenship

As soon as you complete 5 years...you can apply for U.S. Citizenship. Then you can apply for your parents..that process should take about a year at the most. Also...on other note...now you will be eligble to keep your Indian citizenship ...as recently announced by Vajpayee. If you need any help...call me at 818-481-9284!!!
