Legal Question in Immigration Law in California

Green card marriage

My girlfriends Visa expires in August. We are planning to get married and apply for a green card but are unsure of the time it takes to get it. She may have to go back to her country until it is processed but we'd like to make sure that she can definitely come back to the US with no problems. Does it make more sense to marry now and file while separated, or take our chances with a fiance visa and wait until she comes back (if they approve it) ???? Please advise.

Re: Green card marriage

It sounds like you can marry and apply for her green card.

She can remain in the U.S. while it is processing, and travel outside the U.S. after she receives her advance parole travel permit.
