Legal Question in Immigration Law in California

Green Card will expire on 9/12

Hi,

I received my 2 year greencard in sep 12 2008 as a result of a marriage.

I just realized that my greencard will expire on 9/12/2008. Am I too late to file?

I see the form states 90 days. does that mean I should have started 90 days before greencard expires or I could submit anytime before it expires?

If you have not filed yet, you can contact us to discuss your options. Immigration law is very fact specific and it is unwise to give suggestions or advice without knowing the important facts. We have one attorney licensed in the US and Mexico who does most of our non-litigation immigration work. She charges for a consultation but you'd have answers you can rely on from a licensed and insured attorney, and the consultation if free if we work on your case.

You are not supposed to file the removal of conditions, your spouse is! Thus, he or she better hurry up -- it should have been filed at least 90 days before your card expires. Do it now, and it won't cause a problem. If he or she does not want to file it to remove the conditions, you may want to hire a good immigration lawyer to advise you what options you have. Plenty of good immigration lawyers in California -- make sure they are members of the American Immigration Lawyers Assn.

good luck.
