green card/E-B5 IMMIGRATION

we are UK nationals currently on an E-2 visa, which has expired,although our I-94`S continue until june 2008. we have a business in mid CA,which we invested $1.3 mil ( 1031 ), which came from our initial investmant in Florida ( another motel ),which we initaillty invested $600`000.Are we eligible for a green card now ?

You may be eligible to apply for adjustment of status to permanent residence("green card") through an EB-5 petition if you can show that your investment is an "investment-at-risk" (the money must be available and not dormant as a collateral asset). Additionally, you must show that you have hired 5 or 10 U.S. workers (depending on whether your investment is in a targeted area or a regional center).

You should have renewed your visa. In any event in order to apply for greencard ...you need to show that you have invested one million dollars and created 10 jobs. If you are in certain targeted areas that investment requirement is half a million dollars and 5 jobs.
