H1B employee wants to form own company

Hi,

I am employed under H1B visa, but want to form my own company at the same time. Can I do so, say under an L1 visa, while holding the H1B visa as well? This company will be a partnership with a US citizen. Does that change anything?

You cannot be in both H1B and L1 status at the same time. You can, however, have your company sponsor you a part-time H1B visa, so that you will have two H1Bs at the same time.

Hi,

You can not have two visas at the same time. If you want to own your own business you could have an E2 visa if you are from a qualifying country.

You can form your own company with an US citizen...and would be preferable to do a part-time H1b from that company. But there are few other issues you need to pay attention to!! Please e-mail me directly.
