H1-B expired, got a job, need another H1B still in US

Hi,

I was laid off in augusr, and I could not get anybody to transfer H1 with the old company. I donot know what happened with my old H1. I did not leave the country. I recently got another job, they can sponsor my H1. Should they be filing a new H1 or use old H1 for transferring??

If they do file a new h1, do I have to leave the country? Will I be facing any issues when I get my visa stamped. My I-94 is still valid.

I would appreciate if you can guide me with this.

You can do another H1 but will have to explain gap in your work history!!
