H1B Renewal

May I know how long it takes to extend my H1B after 3 years? How much will it cost (filing fees + Attorney fees)? What is the process (meaning do I need to resubmit all document, etc.)? Will appreciate any advice. Thanks.

If you're asking how long it takes to prepare, I like to have a minimum of two weeks to not feel really rushed, but it only takes me about eight hours to prepare an entire case, start to finish over the course of a few days, if I can get everything I need from my client quickly. Attorneys fees vary depending on the lawyer and complexity of the case. Finally, the filing fee varies depending on the size of the employer, whether this is a new employer for you or not. You absolutely must submit all the documents again. It's not just a simple little application.

According to the latest reports, California Service Center is taking about 2 months to approve H-1B extension of stay on Form I-129. The filing fees will be similar to the first time you obtained the H-1B, except that the $500 Fraud Prevention fee does not need to be paid on an extension. Attorney's fees will vary but in the LA area, probably between $1,000 to $3,000 depending on the firm.

You need to submit evidence of continued employment with the same H-1B petitioner, and the approved LCA for the new period requested. Also, obviously evidence of the initial H-1B term of approval you received. There may be more documents needed. You should consult with a qualified immigration attorney or the same one that got you your H-1B.

The filing of the extension of an H-1b petition needs to be prepared with the same care and attention as the initial application. However, if all information is gathered from the first filing and updated information provided, an attorney can typically prepare an application for an extension in less time and for less cost than the initial petition.
