Legal Question in Immigration Law in California

H-1 Petiton

I�m studying MA on F1. I�ll join a company on finishing MA in December. The co. wants to file for H1 right away. Issue: My BA transcripts (& all past educational records) spell my middle name differently from the way it is spelt in my passport/I-20/F-1. In India the 2 spellings are considered equivalent (& common sense would say I�m one & the same person � there�s only one letter diff between the spellings) Would the INS deny/send RFE on the labor cert?

Name on Degree: Bose, Ramesh Ashish Name on Passport/I-20: Bose, Ramesh Asish

If given RFE I dont know how to respond. My legal identity now is my passport with diff spelling as transcripts. (No birth cert) (Reason for diff spellings: my fathers legal name, considered middle name in India is ''Debasish'' & so a passport would only be issued in the name--name removed----name removed--Debasish). I was enrolled in school (first grade) under--name removed----name removed--Debashish. The clerk/officer used this spelling as they�re phonetically ''equivalent'' in India. It never bothered me all these years, & the spelling stuck on throughout my education, until my passport & all subsequent US Ids.

Will INS reject my H1 for this reason?

Your explanation seems reasonable, and the CIS will normally accept a reasonable explanation.
