Legal Question in Immigration Law in California
h-1 problem
Hello,
i have a friend who has an offer from a company and they want to do his h-1b. But his last h-1 from his last company expired last year and since then he's been out of status. Now, my question is can he get his new h-1b approved after being out of status. Or does he have to go back to his country to apply for an h-1b visa from there.

If he is out of status for more than 90 days...he needs to go back and get it from back home!!!

If he has been out of status for more than 180 days, he may have a problem with returning if he leaves the country to apply.
