Legal Question in Immigration Law in California
Hi,
I came from france and I lived here about 5 months. Now I have some problems with my company and maybe they will get me out. Also I have L-1 Visa! So, I need to ask you about taking over my lease for next 6 months.
In fact, I found someone who is willing to take over my lease, but the landlord is saying that if I want to break the lease I need to give a notice and to leave the apartment first and they will see but they are not willing to transfer my lease to someone else!!
Is this legal ?

Review your lease and pay close attention to the section dealing with assignments and subleasing, if any. Also, should you break the lease, the landlord must mitigate his damages. Meaning, if you have a qualified person to take over the lease the landlord cannot deny without good cause.
It looks like your landlord is trying to misappropriate your security deposit.
