Legal Question in Immigration Law in California

Hi!

I am from the Philippines and I was able to get married and was petitioned by my husband just this year and right now we are processing the petition for my 3 children in the Philippines but suddenly my last employer in the Philippines sue me for crime of qualified theft and a warrant of arrest was already issued. Can that affect the petition for our children? Would they be able to deport me and hold the petition for my children? I don't know what to do please advice me I just want to live a new life here in USA for my children and be with them.

I don't believe your children have anything to worry about as long as they are eligible to be sponsored by your husband as their stepfather. As far as you are concerned if you were

able to get your green card that means you probably don't have any criminal convictions on your record. You would not be retroactively deported based on something that is not resolved.

If, later you are convicted, it may affect an application for citizenship but it's difficult to say.
