husband deported to mexico

my husband was deported to mexico for 5 yrs after getting a DUI. can i still get him a green card after the 5 yrs have pass. we have a son who was only 1 week old when this happend.

Yes, you may be able to apply for him now, but on the one hand he may be subject to more than the 5 year bar and on the other hand he may be eligible for a waiver of the bar. I need all the facts.

Actually, he may have qualified for a waiver of the five years apart, but yes, all other qualifications being met, you may file for his return as a permanent resident.
