Legal Question in Immigration Law in California

my husband

he came here illegally. Hes been here for 14 years we have been married for almost 3 years and we have a 16 month old daughter and he got ordered to deport back to india is there anything i can do to stop the deportation? we cant live with out him and its so hard for me as well as my daughter asking for her DaDa

Yes he can seek cancellation of removal. but must move fast. This matter is complex and you should not try to do it yourself so you should get an attorney to discuss your options. Well, I'm fairly sure your husband probably applied for cancellation of removal in the removal proceedings with the aid of his attorney (I certainly hope he had an attorney!), where evidence exceptional hardship to you (if you're a US citizen) and your daughter was already presented to the court. If that was not enough for the immigration judge to stop the removal, then it is not an easy case. He's probably appealing his case right now within 30 days. Again, I certainly hope he does have representation for that. If not, contact my office.

If your husband already applied for either cancellation of removal or asylum and was denied he may not have any good options. However, you may wish to pursue the I-130 and a waiver. You will need an attorney to assist you through this process.
