Legal Question in Immigration Law in California

My husband just received his interview date. I have been told that if my husband has never paid taxes that he will have to pay that before he will be allowed to enter back. But, I have a friend who's husband had an interview recently - had to leave the US for that interview, and came back in about 3 months or so. She said he did not get fined or anything and that he had never filed a tax return. Is it just that some people are asked to pay back taxes to the govt and others arent?

Failure to pay taxes is a reason to deny the benefit of adjustment of status when the interview takes places in the U.S. I've not heard this as a reason for denial at an embassy interview, but as a matter of good practice, I always have my clients pay their tax liability before departing the U.S. Whether it's really mandatory in a particular case is a possibility that a closer look at the situation may reveal.
