Legal Question in Immigration Law in California
I-765 Application
Dear Sir/Ma'm:
I am currently an H1B working VISA holder and is married
to a greencard holder. Can I apply for a work permit
or can my spouse petition me so that I can obtain a work
permit/residency so that I may not anymore renew my H1B under my current employer?
Is I-765, Application for Employment Authorization the
form for work permit application?
Please advise.
Thank you

Re: I-765 Application
No! Unless she petitioned for you years ago. You cannot get a work permit at this time.

Re: I-765 Application
No, you probably cannot if your wife received the green card prior to your marriage.
