Legal Question in Immigration Law in California

i-140 approved, planning for school

I have my I-140 approved in EB-2 category. I plan to apply for B-school next year. What are the chances that I may not get an F1- visa. for shcooling since I have applied for Green card. I am from india and have been working in usa for 3 yrs now.

Are you kidding? The answer is slim to none. Are you here in the U.S.? If so, you may be able to go to school without an F-1 visa, but it depends on the details. If you must apply to business school and are out of the U.S., you will have to convince the consul that you will return after the end of your studies and temporary stay in the U.S. This MIGHT be possible, but it would not be easy to prove.

You will be denied an F-1 visa or an F-1 change of status if you are an intending immigrant. Since you have an I-140 approved, you will be considered an intending immigrant.
