I am from Germany and i am married for almost 3 years. I am supposed to apply for my I-751 on september but things between my husband and i are becoming really difficult. we have a kid but he is drinking a lot (passed out 4 days per week) and he is been really difficult to live with. i would like to leave him but i need to know what is going to happen when i'll file the I-751 alone and if the probability of not having the permanent residency is high. i won't mind to go back home but it will be hard on our kid

To apply for the Removal of Conditions on your permanent residence (Form I-751), you must show that you continue to be married to your U.S. Citizen husband in good faith. However, if the marriage is no longer feasible you may apply for a waiver of the joint petition requirement.

You can apply I-751 requesting waiver of joint petition, but you must be divorced to do it.
