If you have 245 (i) protection, your spouse might petition you for green card application. We suggest you to consult with an immigration attorney.

You are eligible for 245i if an immigrant petition was filed for you before April 30, 2001. If you are not eligible for 245i, you will have to file for an immigrant visa at a U.S. Consulate abroad with a waiver. The waiver must demonstrate that your U.S. Citizen/Lawful permanent resident spouse or parent would suffer extreme hardship if you were not allowed to return to the United States. These are very complex cases and you should seek the assistance of an immigration attorney. Please feel free to contact me for a consultation.
