Legal Question in Immigration Law in California

illegal immigrant and taxes

I am a citizen married to an illegal immigrant. He has a steady job where he

is paid in cash each week. If the congress passes the propostion for guest

workers and the requirement is that you have paid taxes for the past two

years is there a way for us to pay taxes for him now? We have heard that he

can get a tax payer i.d. number, but we are wondering if we should wait to

see what happens in congress or if he should pay taxes this year. If we wait

for congress to pass a new law then it will be too late for him to pay taxes

this year. We don't want to risk the guest worker law passing and him not

being able to apply for citizenship because he has not paid taxes. What do

you reccommend that we do? Thank you.

My recommendation is that he start paying taxes as soon as possible. Otherwise, the accumulation of back taxes owed to the IRS will continue to increase and he will have to pay more money later on.
