Illegal Resident Status
My husband (of mexican decent) and I, (U.S. citizen have been married for 11 yrs. he previously possessed a valid California D.L. but when it expired after the 911 he was unable to renew it. He has no legal status here in the u.s. and now has been charged with a misdemeanor as an unlicensed driver. Is there ANY possible way that he can legally obtain some type of legal document such as; Ca. D.L, itin#, green card or something?

If you have minor children, the only option (and a slim one) would be to apply for a "waiver" in Ciudad Juarez.

Your husband can obtain an ITIN # and a consular ID. I don't know what the DMV in CA requires, but in NV, those are not sufficient to obtain a driver's license. You can petition for your husband. Whether he could adjust here or would have to go back to Mexico and ask for a waiver depends on a couple of factors. Feel free to contact me to discuss further.

The question is why have you not applied for adjustment of status? Did he come in EWI or did he have a passport? Does he still have his passport? You should immediately apply for adjustment and also do a waiver. Please contact one our outstanding deportation attorneys immediately to assist.
